Welcome to Ellen Ausley. These Terms of Service ("Terms") govern your use of our website and your purchase of products from our store. By placing an order, you agree to these Terms. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (ACL) that cannot lawfully be excluded.

2. Orders & Acceptance
When you place an order, you make an offer to purchase the products at the listed price. We accept your offer when we send you an order confirmation email. We may decline or cancel an order where a product is unavailable, where there is a pricing or description error, or where we suspect fraud; in such cases you will receive a full refund of any amount paid.
3. Pricing & Payment
All prices include GST and are subject to change without notice, though changes never affect orders already confirmed. Any promotional or "compare at" pricing reflects the product's previous selling price. We accept major credit and debit cards and the payment methods displayed at checkout. Payment is processed securely at the time of purchase; we do not store your card details.
4. Shipping & Delivery
Delivery timeframes and costs are set out in our Shipping Policy, which forms part of these Terms. Risk in the products passes to you on delivery; title passes on receipt of full payment.
5. Returns & Refunds
Our Returns & Refunds Policy forms part of these Terms. In addition to our 30-day change-of-mind returns, our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
6. Product Information
We take care to display our products, including colours and measurements, as accurately as possible. Slight variations may occur due to screen settings and the dyed nature of some garments. Size guides are provided on each product page to help you choose the right fit.
7. Intellectual Property
All content on this website — including images, text, logos, and designs — is owned by or licensed to Ellen Ausley and may not be reproduced without our written permission.
8. Acceptable Use
You agree not to misuse this website, including by attempting to gain unauthorised access, transmitting malicious code, or engaging in fraudulent transactions.
9. Liability
To the extent permitted by law, and subject always to your ACL rights, our liability for any claim arising out of your purchase is limited to the amount you paid for the relevant products.

These Terms are governed by the laws of Australia. Any dispute will be subject to the non-exclusive jurisdiction of the Australian courts.
